By downloading, accessing, or using SuppDive ("the App"), operated by Ess X LLC, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

SuppDive provides AI-powered supplement analysis through:

• Ingredient identification and analysis
• Evidence-based research from peer-reviewed papers, scientific articles, clinical trials, third-party testing, and reviews
• Safety, efficacy and quality assessments
• Analysis of manufacturer reputation and compliance
• Value assessments and other relevant factors

To use SuppDive, you must first agree to these Terms and our Privacy Policy. Upon agreement:

• An anonymous account is automatically created for basic app access
• You can link or upgrade your account using Apple, Google, or email sign-in
• Free accounts have limited access to basic features
• Full features require an active subscription after the free trial period

For all account types, you agree to:

• Provide accurate information if you choose to link your account
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

5. Acceptable Use

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Attempt to reverse engineer or hack the App
• Upload malicious code or interfere with the App's operation
• Scrape or harvest data from the App
• Misrepresent the App's analysis as professional medical advice
• Share your account with others

6. Intellectual Property

All content, features, and functionality of SuppDive are owned by Ess X LLC and are protected by international copyright, trademark, and other intellectual property laws.

SuppDive Generated Research Data

Important: All supplement analysis, research data, reports, and insights generated by SuppDive's proprietary algorithms and AI based on your scanned images are the exclusive property of Ess X LLC. You receive a license to view, use, and share this generated data for personal and social purposes.

You may:

• Share research findings on social media and with friends/family
• Use our built-in sharing features within the app
• Discuss and reference our analysis in personal conversations

You may not:

• Use our trademarks or logos without authorization
• Create derivative works based on our App
• Resell, redistribute, or commercially use any SuppDive generated analysis
• Claim ownership of any research data we generate
• Use our content for competing commercial purposes

7. User Content

By scanning or capturing supplement images through SuppDive, you grant Ess X LLC an irrevocable, perpetual, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content for any purpose whatsoever, including but not limited to:

• Improving our supplement analysis algorithms
• Building supplement databases
• Research and development
• Marketing and promotional materials
• Creating new features or products

This license continues even if you stop using the app or delete your account.

8. Subscription and Payments

SuppDive is a subscription-based service with the following structure:

• Free Trial: New users receive a free trial period to explore full features
• Free Account: Limited access to basic features after trial expires
• Premium Subscription: Enhanced access to features based on your selected subscription tier

Subscription terms:

• Billing occurs through the App Store or Google Play Store
• Subscriptions auto-renew unless cancelled at least 24 hours before renewal
• Manage subscriptions through your device's app store settings or our own app settings
• No refunds for partial subscription periods
• Prices and plans may change with reasonable notice

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• SuppDive is provided "AS IS" without warranties
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed $100 or the amount you paid us in the past 12 months
• We are not responsible for adverse reactions to supplements

10. Indemnification

You agree to indemnify and hold harmless Ess X LLC, its officers, members, employees, and agents from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

11. Changes to Terms

We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms. We will notify you of material changes through the App or email.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease immediately.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions.
