1. Acceptance of Terms

By downloading, accessing, or using SuppDive's mobile application, website, and all related services (collectively, "the Services"), operated by Ess X LLC, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services.

Age Requirements: You must be at least 16 years old to use the Services. If you are between 16 and 18 years old, you must have your parent or guardian's permission to use the Services and they must agree to these Terms on your behalf. By using the Services, you represent and warrant that you meet these age requirements.

2. Description of Service

The Services provide AI-powered supplement analysis through:

  • Ingredient identification and analysis
  • Evidence-based research from peer-reviewed papers, scientific articles, clinical trials, third-party testing, and reviews
  • Safety, efficacy, and quality assessments
  • Analysis of manufacturer reputation and compliance
  • Value assessments and other relevant factors

The statements made within the Services have not been evaluated by the Food and Drug Administration. These statements and the supplements processed by the Services are not intended to diagnose, treat, cure or prevent any disease.

The Services are not a substitute for professional medical advice, diagnosis, or treatment. The information provided is for educational purposes only. Never disregard professional medical advice or delay seeking it because of something you read in the Services.

Always consult with qualified healthcare providers before:

4. User Accounts

To use the Services, you must first agree to these Terms and our Privacy Policy. Upon agreement:

  • An anonymous account is automatically created for basic access to the Services
  • You can link or upgrade your account using Apple, Google, or email sign-in
  • Free accounts have limited access to basic features
  • Full features require an active subscription

For all account types, you agree to:

  • Provide accurate information if you choose to link your account
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

5. Acceptable Use

You agree NOT to:

  • Use the Services for any illegal or unauthorized purpose
  • Attempt to reverse engineer or hack the Services
  • Upload malicious code or interfere with the Services' operation
  • Scrape or harvest data from the Services
  • Misrepresent the Services' information as professional medical advice
  • Share your account with others

6. Intellectual Property

All content, features, and functionality of the Services are owned by Ess X LLC and are protected by international copyright, trademark, and other intellectual property laws.

Ownership of Generated Output

Ess X LLC owns all right, title, and interest in the Services, algorithms, and any supplement research, analysis, insights and reports generated by the Services ("Generated Output"). We grant you a limited, non-exclusive license to view and reference the Generated Output for your personal, non-commercial use only.

You may:

  • Share research findings on social media and with friends/family
  • Use our built-in sharing features within the Services
  • Discuss and reference our analysis in personal conversations
  • Use the Generated Output for personal purposes

You may not:

  • Use our trademarks or logos without authorization
  • Create derivative works based on the Services
  • Resell, redistribute, or commercially use any SuppDive generated analysis
  • Claim ownership of any research data we generate
  • Use our content for competing commercial purposes

Note: This section governs intellectual property ownership only. Data handling and privacy matters are governed by our Privacy Policy.

7. User Content

By scanning or capturing supplement images through the Services ("User Content"), you grant Ess X LLC a worldwide, royalty-free, and non-exclusive license to reproduce, adapt, modify, and use such User Content for the purpose of:

  • Providing and operating the Services for you
  • Processing and analyzing supplement information
  • Improving our supplement analysis algorithms and accuracy
  • Building and maintaining our supplement database
  • Developing new features within the Services

You retain ownership of your User Content. You represent and warrant that you have all necessary rights to grant this license and that your User Content does not violate any third-party rights or applicable laws.

This license continues for as long as necessary to provide the Services, even if you stop using the Services or delete your account, but only for the purposes stated above.

8. Subscription and Payments

The Services are subscription-based with the following structure:

  • Free Account: Limited access to basic features
  • Free Trial: New users may receive a free trial period to explore full features upon their consent
  • Premium Subscription: Enhanced access to features based on your selected subscription tier

Subscription terms:

  • Billing occurs through the App Store or Google Play Store
  • Subscriptions auto-renew unless cancelled at least 24 hours before renewal
  • Manage subscriptions through your device's app store settings or through the Services settings
  • No refunds for partial subscription periods
  • Prices and plans may change with reasonable notice

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The Services are provided "AS IS" without warranties
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed $100 or the amount you paid us in the past 12 months
  • We are not responsible for adverse reactions to supplements processed by the Services
  • We are not responsible for how you interpret or act upon information provided by the Services

10. Indemnification

You agree to indemnify and hold harmless Ess X LLC, its officers, members, employees, and agents from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

11. Changes to Terms

We may modify these Terms at any time. Continued use of the Services after changes constitutes acceptance of the new Terms. We will notify you of material changes through the Services or email.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Services will cease immediately.

13. Beta Services

We may release products and features that we're still testing and evaluating ("Beta Services"). Beta Services will be labeled as "beta," "preview," "early access," "experimental," or with similar words.

Beta Services are provided "as is" and may:

  • Contain errors, bugs, or inaccuracies
  • Result in unexpected behavior or data loss
  • Be modified or discontinued at any time without notice
  • Not be as reliable as our other services

Your use of Beta Services is voluntary and at your sole risk. We may contact you to collect feedback about Beta Services. Any feedback you provide may be used by us without obligation to you.

14. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law provisions.
